ListingClips is an AI powered real estate photo to video platform that allows users to upload images, generate videos, apply camera movements, add music, use templates, edit content, export media, and use other available real estate media creation tools.

The service is provided online and may require an active internet connection.

3. Eligibility

You must be at least 18 years old to use ListingClips.

By using ListingClips, you confirm that you are at least 18 years old and have the authority to agree to these Terms.

4. Account Registration

To use certain features of ListingClips, you may need to create an account using email and password or Google OAuth authentication.

You are responsible for:

• Providing accurate account information
• Keeping your login credentials secure
• Maintaining control of your account
• All activity that occurs under your account

You must notify us immediately if you believe your account has been compromised.

5. Subscription Plans, Billing, and Auto Renewal

You may cancel your subscription at any time through your account settings, billing portal, or by contacting hello@listingclips.com.

Cancellation will stop future renewal charges but does not automatically refund prior payments.

If you cancel a subscription, you may continue to have access to paid features until the end of the current billing period unless otherwise stated.

We aim to provide a simple cancellation process. If you signed up online, we will provide an online cancellation method where legally required.

7. Refund Policy

A. 7-Day Money-Back Guarantee

If you are not satisfied, you may request a full refund of your first paid subscription charge within 7 days of that charge by emailing hello@listingclips.com. The refund is not conditioned on whether you have generated videos, used credits, or exported media during that period.

This guarantee applies once per customer and to your initial purchase only. Renewal charges, additional credit packs, and add ons are covered by the standard policy below. We may decline refunds where we reasonably determine the guarantee is being abused (for example, repeat refund-and-resubscribe cycles).

B. After the Guarantee Window

Beyond the 7-day window, subscription payments are non-refundable except where required by law. You may cancel at any time to stop future renewals; cancellation stops future charges but does not refund the current period, and you keep access and credits through the paid period (see Credits).

We may approve or deny refund requests at our sole discretion, subject to applicable law.

9. Prohibited Content

You may not upload, generate, submit, or distribute content that:

• Infringes copyrights, trademarks, or other intellectual property rights
• Violates privacy, publicity, or contractual rights
• Contains malware, viruses, or harmful code
• Is unlawful, fraudulent, deceptive, or misleading
• Contains hate, harassment, threats, or abuse
• Contains sexually explicit material
• Contains graphic violence or illegal activity
• Impersonates another person or business
• Misrepresents a property, listing, agent, brokerage, or service
• Violates MLS, real estate platform, advertising, or brokerage rules
• Violates local, state, federal, or international law

We may remove content, suspend accounts, or terminate access if we believe content violates these Terms or creates legal, operational, or reputational risk.

10. Copyright, DMCA, and Takedown Policy

ListingClips respects intellectual property rights.

If you believe content on ListingClips infringes your copyright, you may send a takedown notice to our designated copyright contact.

11. AI Generated Content

You acknowledge the following:

• AI generated videos may contain inaccuracies or unintended artifacts.
• You must review all generated videos before using them commercially.
• ListingClips is not responsible for errors caused by AI output.
• ListingClips is not liable for any false advertising flags triggered by third party platforms, including real estate listing services.

12. Commercial Use

You are permitted to use ListingClips outputs for commercial purposes, including real estate marketing, listings, or promotional materials.

You may not:

• Scrape data from the service
• Reverse engineer, decompile, or disassemble any part of the platform
• Interfere with servers, security systems, or network operations
• Upload malware or attempt to gain unauthorized access

We may suspend or terminate accounts that violate these terms.

15. Service Availability

ListingClips is provided as is and may experience downtime for maintenance, updates, system issues, or circumstances beyond our control. We do not guarantee uninterrupted uptime.

16. Limitation of Liability

To the fullest extent allowed by law:

• ListingClips is not liable for any indirect, incidental, special, consequential, or punitive damages.
• We are not liable for lost profits, lost listings, lost sales, lost opportunities, or business interruptions.
• We are not liable for any issues resulting from AI generated output.
• We are not liable for real estate listing rejections, removals, or compliance flags.

Your sole remedy for dissatisfaction with the service is to stop using ListingClips.

17. Termination of Accounts

We may suspend or terminate your account at any time for:

• Non payment
• Abuse of service
• Uploading harmful or unlawful content
• Violating usage limits
• System misuse
• Any activity that may harm the platform or other users
• Any reason at our sole discretion

18. Third Party Services

ListingClips uses third party services such as Stripe, Firebase, AWS, Google Cloud, Google Analytics, Meta Pixel, and Google Tag Manager. These providers may independently collect and process data as described in their own privacy policies.

19. Affiliate and Referral Program

If ListingClips launches an affiliate or referral program, participation will be governed by separate terms. We may modify or discontinue the program at any time.

20. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to conflict of law principles.

21. Dispute Resolution

Any disputes should first be attempted to be resolved informally by contacting hello@listingclips.com.

22. Changes to Terms of Service

We may modify these Terms of Service at any time. Updated terms will be posted with a new effective date.

Continued use of the service after changes means you accept the updated terms.
